New Sales Disclosure Statement - Now Mandatory for Queensland Sellers


From 1 August 2025, a new Seller Disclosure Scheme will take effect across Queensland. This means that property sellers will now be legally required to provide a disclosure statement to prospective buyers before signing a contract.

The new rules aim to improve transparency and reduce surprises during the sale process. The Standard Disclosure Statement includes:
  • Title details

  • Easements and covenants

  • Zoning information

  • Notices or proposals affecting the land

  • other relevant property information

Consequences of Non-Compliance

If the seller fails to provide a compliant statement, the buyer may be able to terminate the contract any time before settlement.  Also, if the statement is inaccurate or incomplete on a material matter, and the buyer was not aware of the correct state of affairs when signing, they may have the right to terminate the contract at any time.  We recommend sellers engage their solicitor to ensure all required documentation is in order and given to the agent to include in the sales process.
